Terms of Service

1. Agreement to Terms

By accessing or using FlowsKit ("the Platform") at flowskit.org, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. FlowsKit reserves the right to modify these terms at any time; continued use after changes constitutes acceptance.

2. Platform Overview

FlowsKit is a digital marketplace where users can buy and sell AI assets including prompts, agents, skills, tools, workflows, templates, and datasets. The Platform facilitates transactions between sellers and buyers but does not itself create or endorse any listed content.

3. Accounts

You must create an account to purchase or sell on FlowsKit. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date. FlowsKit reserves the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to:

• Upload or sell content that infringes on third-party intellectual property rights
• List malicious prompts, agents, or workflows designed to exploit AI model vulnerabilities (jailbreaks, prompt injection attacks)
• Use the Platform to distribute spam, malware, or harmful content
• Create multiple accounts to circumvent bans or manipulate reviews
• Scrape, crawl, or automatically extract data from the Platform without written permission
• Reverse engineer or attempt to extract source code from the Platform
• Engage in any activity that disrupts or degrades Platform performance
• Resell or redistribute purchased items outside the terms of their license

5. Seller Obligations

5.1 Eligibility

To sell on FlowsKit, you must connect a valid Solana wallet address to receive USDC payments. You must be at least 18 years of age or the age of majority in your jurisdiction.

5.2 Listing Requirements

Listings must include accurate descriptions, clear usage instructions, and honest capability claims. Prices must be between $2.99 and $99.99 per listing. All listings are subject to review and approval by FlowsKit before becoming publicly visible.

5.3 Content Ownership

You represent that you own or have the right to sell all content in your listings. By listing content on FlowsKit, you grant us a non-exclusive, worldwide license to display, distribute, and promote your listings on the Platform.

5.4 Platform Commission

FlowsKit retains a 15% commission on every sale. The remaining 85% is paid to the seller in USDC via Solana. Commission is non-negotiable and is deducted automatically at the time of transaction. Solana network fees (typically less than $0.01) apply in addition to the platform commission.

5.5 Tax Responsibility

Sellers are responsible for reporting and paying all applicable taxes on their earnings. FlowsKit may provide transaction summaries but does not offer tax advice.

6. Buyer Rights

6.1 License to Use

When you purchase a listing, you receive a non-exclusive, non-transferable license to use the purchased content for your personal or commercial projects, unless the seller specifies otherwise in the listing description.

6.2 Free Preview

Buyers may test each prompt once using the live preview feature before purchasing. This preview is provided "as-is" and results may vary depending on the AI model and input parameters.

6.3 No Redistribution

You may not resell, redistribute, or publicly share purchased content. You may not claim authorship of purchased content or list it for sale on FlowsKit or any other platform.

7. Refund Policy

Due to the digital nature of the products sold on FlowsKit, all sales are generally final. However, refunds may be granted in the following circumstances:

• The listing is substantially different from its description
• The content is non-functional, incomplete, or corrupted
• Duplicate charges due to a technical error

Refund requests must be submitted within 14 days of purchase by contacting support@flowskit.org. FlowsKit reviews each request on a case-by-case basis and reserves the right to make final refund decisions. Approved refunds are processed back to the original payment method within 5-10 business days.

8. Intellectual Property

8.1 Platform IP

The FlowsKit name, logo, website design, and source code are the intellectual property of FlowsKit. You may not copy, modify, or use our branding without written permission.

8.2 User Content

Sellers retain ownership of the content they list. Buyers receive a usage license as described in Section 6. FlowsKit does not claim ownership of user-generated content.

8.3 DMCA & Takedowns

If you believe content on FlowsKit infringes your intellectual property, you may submit a takedown notice to legal@flowskit.org. We will investigate and remove infringing content in accordance with applicable law. Repeated infringement will result in account termination.

9. Account Termination

FlowsKit may suspend or terminate your account at any time for violation of these terms, including but not limited to:

• Listing fraudulent, plagiarized, or prohibited content
• Engaging in abusive behavior toward other users
• Attempting to circumvent the platform commission
• Repeated copyright infringement
• Any activity that violates applicable laws

Upon termination, your access to the Platform is revoked. Pending payouts may be withheld if the termination results from a terms violation. You may appeal a termination by contacting support@flowskit.org within 30 days.

10. Disclaimers

FlowsKit is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that listed prompts, agents, or workflows will produce specific results. AI outputs vary based on model, parameters, and input. We are not responsible for the quality, accuracy, or safety of content created by sellers.

11. Limitation of Liability

To the maximum extent permitted by law, FlowsKit and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim arising from these terms shall not exceed the amount you paid to FlowsKit in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless FlowsKit from any claims, damages, or expenses arising from your use of the Platform, your violation of these terms, or your infringement of any third-party rights.

13. Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration, except where prohibited by law.

14. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
